Copyright Policy
How to raise an intellectual property concern about anything we publish, and what we will do about it.
1. Overview
Jumi Ltd respects intellectual property rights and expects users of the JUMI Colour Generator to do the same. This policy explains how to raise a copyright concern with us and what we will do about it.
This policy is deliberately different from the notice-and-takedown policies you may have seen on platforms that host user content, for the reason explained in Section 2.
2. What we host, and what we do not
The JUMI Colour Generator runs entirely in your browser. The palettes and gradients users create, and anything they save, are stored on the user's own device. They are never uploaded to our servers, and we cannot see, retrieve or remove them.
The content we do publish and control is:
- the Curated Palette collection: the ready-made palettes we publish in the tool, with their names and descriptions;
- the website itself: its guides, articles, examples, text, graphics, branding and code.
A takedown request to us can therefore only meaningfully relate to that content. We cannot "take down" a user's palette, because we do not host it.
It is also worth saying plainly: individual colours and their hex, RGB or HSL values are not, in general, capable of copyright protection under the law of England and Wales. A notice asserting copyright in a colour is unlikely to succeed. Concerns about a colour used as a brand identifier are trade mark or passing-off matters and belong with the party using the colour, not with us.
3. Reporting a copyright concern
If you believe any part of our Curated Palette collection, our written content or our website infringes copyright or another intellectual property right that you own or represent, email legal@jumi.uk with the subject line "Copyright notice" and include:
- Identification of your work: what it is, and evidence of your rights in it (for example a registration, publication date or link to the original);
- Identification of our material: which palette, article, image or page you are concerned about, precisely enough for us to find it (a screenshot or URL helps);
- The basis of your concern: why you consider our material infringes;
- Your details: name, organisation if relevant, and contact information;
- A statement that you believe in good faith that the use is not authorised by the rights owner, and that the information in your notice is accurate and that you are, or are authorised to act for, the rights owner.
4. What we do when we receive a report
- We will acknowledge your notice within 5 working days.
- We will investigate, which may include reviewing our creation records for the material in question and seeking legal advice.
- Where a concern is substantiated, we will remove or replace the material, normally within 10 working days of concluding our investigation.
- We will tell you the outcome. If we do not agree the material infringes, we will explain why, and the matter can be pursued through the usual legal channels.
Removing material from the site does not retroactively affect designs users have already produced; those exist only on users' devices and in users' own projects.
5. Concerns about designs made with our tool
If your concern is about a design, brand or product someone has created using colours from our tool, rather than about our own published content, we are not the right recipient: we do not host user designs, we have no copy of them, and we have no relationship with the sites or marketplaces where they may appear. You should direct your complaint to the person using the design or to the platform hosting it (most platforms operate their own IP complaint procedures).
Our Website Terms of Use prohibit users from using the Service to imitate another business's get-up or brand colours in order to pass their goods or services off as that business's, and we will cooperate with lawful requests from courts and authorities in connection with unlawful use of our Service.
6. Misuse of this process
Submitting knowingly false or misleading copyright notices wastes everyone's time and may expose you to legal liability. We reserve the right to disregard notices that are abusive, plainly unfounded or repeatedly resubmitted without new substance.
